USCIS announces Employment Based Green Cards increased to 197,000 from 140,000 for FY 2023

 

The Department of State (DOS) currently estimates that the FY 2023 employment-based annual limit will be approximately 197,000, due to approximately 57,000 unused family-sponsored visa numbers from FY 2022 being added to the employment-based limit for FY 2023. 197,000 is higher than the statutory limit of 140,000 but below the annual limit for the past two fiscal years. USCIS is committed to use all available visas for this fiscal year which ends September 30, 2023.

Background: The 140,000 limit is divided among EB1, EB2, EB3, EB4 and EB5 categories. EB1, EB2 and EB3 each receive 28.6% (40,040) of the 140,000 limit. EB4 and EB5 each receive 7.1%) (9940) of the 140,000 limit. Unused family visas are applied the same percentages to each of the employment based categories. Adjustment of Status applications cannot be approved unless the final action date priority date is current.
